Have the same rack and not had a problem yet. Went and looked at mine after seeing your pictures, pushed down real hard at the pivot points and did not touch the deck lid. Maybe you have a faulty rack
I would get intouch with the people you bought it from and 
on them. Hope you get it squared away.
