General Motors Recalling Vehicles to Fix Fluid Leak

NEW YORK (Associated Press) - General Motors Corp. said Friday it was recalling about 313,000 passenger cars and crossover vehicles to fix a fluid leak that could lead to the driver losing control of the vehicle.
The recall involves 275,936 vehicles in the United States, including the 2005-2007 Cadillac CTS and STS sedans, 2005-2007 Cadillac SRX crossovers, and 2006-2007 Pontiac Solstice and the 2007 Saturn Sky convertibles. About 38,000 additional vehicles are under recall in Mexico, Canada, the Middle East and Asia, GM said.
GM said the seal on the rear axle pinion, which provides power to the wheels, does not meet all specifications and could leak fluid. GM spokeswoman Carolyn Markey said the leak could lead to the drivewheel jamming up and locking while the vehicle is being driven, possibly causing the driver to lose control.
There has been one crash reported in which the rear wheels locked because of the leak and hit another car. In a separate incident, a driver reported an injury after moving around in the car as the vehicle lost control.
Markey said there have been "a higher than normal" number of warranty claims because of the problem.
The recall is expected to begin in February 2008 and dealers will replace the pinion seal free of charge. Owners may contact Cadillac at (800) 982-2339, Pontiac at (800) 620-7668 and Saturn at (800) 972-8876.
I suspect a Lemon is a Lemon even with the recall situation. Follow your states laws regarding this process and keep good records. The fact that a recall has occured should have added value if you are in the lemon process.

All repairs covered under warranty.
My initial thought is that a recall won't count for lemonade. This is a voluntary action by GM. One part of the letter says "Dealer will replace pinion seal" but elsewhere calls for inspection first. Until the dealer and customer letters come out it would remain somewhat unclear if each and every vehicle in the timeframe will get a new seal, and if any that have already been replaced have yet to have the newest seal, and therefore might get done all over again.
Think of it in this light, if this fix is truly a permanent fix then it is a fiax and not a failure to correct. Only failures to correct would stack up for lemon law. For example your state says three failed attempts at repair and you have already had two selas replaced, even one time including a complete diff, this third seal fixes teh problem and it never raises its ugly head again; voila, no lemon.

Whoohoo. I'm glad they recalled before mine went out. I've got an 07 GXP with 8,500 miles on it. It won't be long from what I've heard. 275,936 Vehicles. Thats a lot.

Most states' lemon laws require that a vehicle have multiple problems within a specified time frame (e.g. within one year of sale). If, like me, you've had one leak per year, the lemon law process won't help you in most states. However, having this as a recall item might help those who have had their warrantee lapse.

My 06 Solstice has 16,000 miles and has not had one issue (with anything).
Is it just me or is that good for a first year model?
